User Agreement & AI Policy

Welcome to KindPath — a digital platform designed to help adults 18+ strengthen emotional wellness through daily check-ins, pattern recognition, and peer connection. This User Agreement sets forth the terms and conditions governing your use of KindPath, and incorporates our AI Policy Agreement to ensure transparency and trust in how we use technology.

By creating a KindPath account or using our services, you agree to the terms below. If you do not agree, you may not use the platform.


1. Definitions

For purposes of this Agreement:

  • “Services” means all KindPath software, mobile applications, features, and related content.

  • “User Data” means any information you provide to KindPath, including health, wellness, and personal details.

  • “De-Identified Data” means data that has been stripped of personal identifiers and cannot reasonably be re-associated with you.

  • “AI” means machine learning and natural language processing systems used to generate insights or suggestions.

  • “Providers” means licensed healthcare professionals connected to your account through the KindPath provider portal.

  • “Peer Support” means connections with other users who share lived experience, not professional counseling.


2. Eligibility

You must:

  • Be at least 18 years old

  • Reside in the United States

  • Not be using KindPath for acute or emergency care needs

KindPath is not a telehealth provider and does not provide diagnosis, treatment, or emergency services.


3. Our Services

KindPath offers:

  • Daily AM/PM check-ins to track mood, stress, and related wellness indicators

  • Pattern and trend summaries

  • Peer and provider connection options

  • AI-assisted insights to help you reflect and self-manage emotional wellness

  • A private in-app messaging feature for provider-linked users


4. Privacy & Data Protection

  • We comply with HIPAA where applicable.

  • Your personally identifiable health data is protected through encryption in transit and at rest.

  • Your data will never, under any circumstances, be sold to third parties for marketing, advertising, or any other purpose.

  • We may share limited, de-identified, and aggregated data with trusted partners solely to improve platform functionality and research outcomes — never for commercial resale.

  • We fully de-identify user data before training our AI models in accordance with the HIPAA Privacy Rule Safe Harbor.

  • We do not store or process audio or full-text transcripts of your in-app interactions.

5. AI Policy Agreement


5.1 Purpose of AI in KindPath

Our AI:

  • Identifies trends and changes in your emotional wellness

  • Suggests coping strategies or prompts based on your input patterns

  • Supports provider reports with behavioral summaries

  • Flags potential high-risk patterns for review by human moderators (without disclosing your “risk level” directly to you)

5.2 Human-in-the-Loop

AI output is never used for direct clinical decision-making without human review. Providers and/or KindPath moderators oversee AI-flagged insights.


5.3 Data Use for AI Training

  • Data is de-identified before use

  • No raw conversation data is shared with third parties for model training

  • We may use aggregated patterns to improve feature accuracy

5.4 AI Limitations

  • AI is not a substitute for professional mental health care

  • Insights are based on available data and may not reflect all aspects of your mental health

  • AI outputs may not always be accurate — you should interpret them as supportive tools, not medical advice


6. User Consent to Communication

By creating an account, you agree to receive in-app messages, emails, and (if you opt in) SMS notifications related to your use of KindPath. You may opt out of marketing communications at any time.


7. Your Responsibilities

You agree to:

  • Provide accurate information in your check-ins

  • Keep your login credentials secure

  • Notify us immediately of any unauthorized access to your account

  • Use KindPath respectfully and lawfully

  • Avoid using the platform for harmful, harassing, or exploitative purposes


8. Payments & Subscriptions

  • Direct-to-consumer subscriptions are billed at $9.99/month (with a 7-day free access period)

  • Provider-referred accounts may be billed to the provider or health system


9. Intellectual Property

All software, designs, text, graphics, algorithms, and branding are the property of KindPath or its licensors. You are granted a limited, non-transferable license to use the Services for personal, non-commercial purposes.


10. Disclaimers

KindPath is not an emergency service and does not monitor messages or activity for crisis situations in real time. If you are in crisis, call or text 988 or use other emergency resources.


The Services are provided “as is” without warranties of any kind, express or implied.


11. Limitation of Liability

To the fullest extent permitted by law:

  • KindPath shall not be liable for indirect, incidental, special, or consequential damages.

  • Our total liability to you for any claims shall not exceed the greater of $100 or the amount you paid in the past 12 months.


12. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Minnesota, without regard to its conflict of laws principles.

Any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association. You waive any right to participate in a class action.


13. Third-Party Services

Some features may rely on third-party services (e.g., payment processors, EHR integrations). Your use of these features is subject to those services’ own terms and privacy policies.


14. Account Termination

 You may close your account at any time via your Settings menu in the mobile app.


Upon closure:

  • Personal Data Removal: We will permanently delete all personally identifying information from our active systems within 30 days, subject to any legal or regulatory retention requirements.

  • Retention of De-Identified Data: We may retain de-identified and aggregated data derived from your usage for analytics, service improvement, AI model training, and behavioral health research.

  • Definition: “De-identified” means your data has been processed to remove all direct and indirect identifiers in compliance with HIPAA Safe Harbor and/or Expert Determination standards, such that it cannot reasonably be re-associated with you.

  • Use Limitations: De-identified data will only be used for purposes consistent with KindPath’s mission and will never be sold to third parties for unrelated purposes.

  • Opt-Out Right: You may request to have your data excluded from retention before deletion. Once data is de-identified, it cannot be re-linked to you or removed retroactively.

We reserve the right to suspend or terminate accounts that violate this agreement.


15. Changes to This Agreement

We may update this agreement periodically. We will notify you via in-app message or email.

17. Consent & Acceptance

By clicking “I Agree” or otherwise using KindPath, you:

  1. Acknowledge that you have read, understood, and agree to be bound by the terms of this User Agreement and the AI Policy.

  2. Consent to the collection, use, and disclosure of your data as described in our Privacy Policy, including the use of de-identified data to improve KindPath’s services and AI models.

  3. Understand that KindPath is not a telehealth provider, does not offer medical advice, and is not an emergency service.

  4. Acknowledge that our AI tools are supportive aids, not substitutes for professional clinical care, and that any AI-generated insights are informational only.

  5. Confirm that you are at least 18 years of age and legally able to enter into this agreement.

  6. Agree to receive service-related communications from KindPath, with the option to opt out of marketing messages at any time.
